Although many Republican lawyers and legal scholars (see Charles' Fried's recent op-ed as an example) do not believe the individual mandate is unconstitutional, the constitutionality of the affordable care act increasingly has become a constitutional debate between politicians and political operatives in the two major political parties-- a political controversy, that, not surprisingly, has now been carried to the federal courts for resolution.
