Earlier this year the Court of Appeal (as noted by the IPKat here in "Now you can buy milk without being shot", allowing David's appeal) refused to strike out an action brought on behalf of the child, considering that it was at least arguable that David had a reasonable expectation of privacy and that the balance between Articles 8 and 10 of the European Convention on Human Rights should be struck in his favour.
