Supreme Court rules on the constitutionality of lethal injection as a means of execution.However, Superior Court Judge Stephen Scarlett ruled that a pre-trial hearing Monday about potential evidence in the case will proceed.Yancey and Beall will be allowed during the hearing to ask that individual motions be taken up at a later date, Scarlett said in a written order denying the motion for continuance.
