The court's expert didn’t expressly conclude that the remaining Doe defendant wiped his hard drive, but his opinion on the date of installation of the operating system (presumably) led the remaining defendant to admit not only that he wiped the hard drive, but that he also downloaded Malibu’s copyrighted material. Then, once you'd identified owners of the technology, you'd want to check county courthouses in those jurisdictions (and the federal PACER system) for civil litigation and perhaps file a second round of open records requests related to policies, correspondence, etc,. about the device. [read post]

Pietz suggests that the ex parte application may not be online yet because they filed it manually at the clerk's office rather than by e-filing it on the electronic filing system, which automatically and immediately places it on PACER. [read post]
