If I were running the bank, once I found out about the deeds, I would have quitclaimed the derelict rat-traps to the mayor and demanded that he be given the death penalty.As it was, the bank claimed (quite correctly) that it couldn't be forced to accept title to collateral, was not the owner, and didn't need to show up in court to face criminal charges. Co., Inc. states what I believe is the correct interpretation of Insurance Law § § 3420(a)(3) and 3420(d) with respect to late notice of lawsuits: "The fact that defendant [insurer] omitted from that notice any specific reference to the injured party's own failure to afford the insurer timely notice [of the underlying lawsuit] did not prejudice plaintiffs.
