Basically, up until just last week with the Murphy v IRS decision, the advice given has been that it pays to be somewhat aggressive in your tax stance, with the belief that the IRS isn't likely to want to audit the returns of such a tragic and sympathetic group of plaintiffs and potentially disallow their tax free damages.
