And so at that hearing if they cannot show that they have a defense to the keeping of the child then the child is turned over typically you can get attorney’s fees for doing this there is no sanction there’s no punishment there’s no jail time in a writ of habeas corpus it’s return of the child and then in addition to that there is an attorney fee award that you can prove up.
