Surprisingly (to this Kat at least), the judge concludes that claim 3 is “an alternative to claim 1”, based on a paragraph in the description which reads: [0017] It has proved to be of practical advantage if the optical beam deflector device 2 is disposed on the side of the inverting system 1 facing towards the eyepiece 5.
