Despite my admiration for Orin Kerr's mix of scholarship and practicality, one area where I disagree strongly with him is his "technology neutral" approach to search and seizure, where he essentially seeks to apply the law developed over the years to deal with brick and mortar, car chases and snail mail, to the digital world by analogy. Thanks to activist Noah Newkirk, we’ve recently been reminded that federal law makes it a crime to “make a harangue or oration, or utter loud, threatening, or abusive language in the Supreme Court Building or grounds” (at least if you’re not a justice or a litigant). [read post]

And I’d add a third reason: if judges’ can freely express their discomfort with the law they’re upholding and the rules they’re upholding it under, it reduces the temptation they might have to distort the law so as to not be seen as endorsing the law and the underlying doctrine. [read post]
