The German federal constitutional court, on the other hand, stated in February 2023 that the Act on Data Processing by the Police for the Land of Hamburg violated the constitution, on the grounds that ‘when stored data is processed by means of automated data analysis or interpretation, this constitutes an interference with the informational self-determination of all persons whose personal data is used in such processing’ (1 BvR 1547/19, 1 BvR 2634/20).
