If Judge Mukasey does in fact believe the president can disregard federal statutes in the kind of cases described above, it makes no difference whether the otherwise valid statute is said to "become unconstitutional" in these cases (on the ground that it impinges on Article II) or whether instead the president is simply said to be constitutionally supreme (vis-a-vis Congress) on matters that fall within his commander-in-chief power.
