A better way would be to supplement the "preservation of filing requirements" provisions under Section 18(c)(2) of the Securities Act, to make abundantly clear to the courts that states retain authority to intervene should their review of the Reg D filings that come in (state authority to require issuers to make a notice filing of the Reg D filing is already in the law) surface names of bad actors.
