On severability, the government wanted the Court to rule that, if it nullified the individual mandate, it should also “sever” (and thus salvage) the rest of the Act, with only two exceptions: the requirement that the insurance companies not turn away insurance applicants with preexisting medical conditions, and the provision that companies could not raise their premiums without limit to cover their new coverage obligations.
