Well done, LexisNexis Butterworths, for unearthing Knight v Beyond Properties Pty Ltd and others [2007] EWHC 1251 (Ch), an obscure ruling by Mr Justice David Richards in the Chancery Division yesterday on a neat little passing-off point.Knight, a British citizen who lived in Australia, published three books in the UK between 1991 and 1996; each had the word 'Mythbusters' in its title. This claim was a bit of an optimistic punt into the judicial stratosphere based on the recent Court of Appeal decision in Yeda Research v Rhone-Poulenc [2006] EWCA Civ 1094 at paragraph 13 where Lord Justice Jacob said: "This does suggest that there may be a jurisdiction to grant even an ousted patentee a licence.
