The Oregon State Bar recently joined the pack in December of 2011 when it issued Formal Opinion No. 2011-188 concluded that Oregon attorneys may store client materials a third-party servers as long as there is compliance with the Oregon Rules of Professional Responsibility’s duties of competence and confidentiality which require lawyers to take reasonable steps to ensure the security of confidential client information. At a minimum, Oregon law needs to be changed so that compensation paid to employees by the state, or by any political subdivision in the state, is treated as Oregon-source income and subjected to Oregon personal income tax, no matter where the employee lives or performs the work. [read post]

These are really important state rule changes for tribes and Native families–the cost of pro hac in Oregon alone is $500, and in other states tribal attorneys are still being denied the right of intervention without following long and onerous pro hac requirements–sometimes making it impossible to participate in child welfare hearings involving Native kids.
