Abril is attempting to move away from the traditional privacy tort analysis, perhaps the original Restatement language stating that the disclosed information must be "highly offensive to a reasonable person" would be appropriate here in order to give the court some kind of benchmark for what degree of harm must be involved in order for the court to grant relief.
