The local appraisal review board subsequently upheld that valuation, as did the state District Court where Marathon brought suit contending that the out-of-state portion of the products should not have been included in its taxable inventory because they were exempt under federal law (i.e., the Commerce Clause) and thus were exempt from local property taxes under Texas Tax Code Section 11.12.
