There is, of course, the separate problem of racial targeting in immigration stops that doesn't arise in drunk driving checkpoints, but that wouldn't apply to a law that required the police to check everyone for immigration violations, as I understand at least parts of the Arizona law dictate.Or one could argue that drunk driving stops are less burdensome than sobriety checkpoints, but I'm not sure that's empirically true. Which is true testament an honest and rational attempt to properly distinguish a case: a description that makes the differences between the two cases matter, and make both cases understandable given their factual predicates.So I was very impressed with this opinion, especially since the issue seemed so facially intuitive at the outset. Let me give you a list of things not to do: (1) Have sexually provocative chats with an alleged 13-year old over the internet over a six-month period; (2) Eventually reveal your true age (after pretending to be a 19-year old "stud") and identity to the unknown person on the other end of the line; (3) Transmit video footage of yourself masterbating to said alleged 13-year old; (4) Travel for planned sex with said (needless to say, fictional) 13-year old. But if (1) is true then prosecutorial misconduct during closing argument is never reversible error, and this seems an extremely poor case in which to argue (2) given that (as far as I can tell from the opinion) the only evidence against defendants consisted of (notoriously unreliable) eyewitness identifications given over a year after the crime.
