Shortly after the current dispute broke out in January, Apple started filing IPR petitions against patents that Samsung had challenged before, which I described as "piggybacking" on Samsung's 2021 campaign.Seven of those petitions targeting patents-not-in-suit have been denied, and most of those patents are young enough that Ericsson may very well elect to assert them on some other occasion. [read post]

Her most amazing achievements include a settlement with Samsung that according to sources I can't disclose cost the latter roughly a billion dollars, the annulment of the European Commission's 13-billion euro decision in the Apple Ireland (a decision by the EU General Court that the European Commission is appealing), and most recently the antitrust acquittal in the Epic Games case (the consolation prize that Epic won under California UCL is negligible at best).Follow @FOSSpatents … [read post]

While it's always possible that parties reach a settlement in one jurisdiction (or set of jurisdictions), such as when InterDigital settled some European cases but litigation kept going in the United States or when Samsung and Apple withdrew all ex-U.S. lawsuits (but not the ones pending before Judge Koh), most negotiations will result in a global license for convenience. Samsung's aggressive SEP assertions against Apple did raise a serious issue, but it took a presidential veto for the public interest to prevail.I actually think it is in the ITC's institutional interest not to allow abse of its Section 337 proceedings for anticompetitive purposes. [read post]

As I found out last month, K.Mizra is asserting another patent--which was also originally obtained by the Dutch research institute I mentioned further above--against Samsung, and if Samsung's phones infringe, then it's actually Google's Android mobile operating system that implements the patented technique.Niantic was granted leave to file a post-trial brief, but the fact that the ruling is scheduled for five weeks from now--and three weeks after the deadline for… [read post]

As for the 5G part, Judge Koh doesn't mention Qualcomm's deal with Samsung, but the fact that this modification of an agreement with the world's largest smartphone maker (at least by some measure) occurred prior to the cutoff date also suggests that whatever other deals were struck in the second or third quarter of 2018 won't present a fundamentally new situation.
