The Supreme Court said the Appointments Clause didn't apply: the merchant appraiser was selected on an ad hoc basis for cases where appraisals were requested; he didn't fall within the civil-service law; the statute just required that he be a "discreet and experienced merchant"; and he lacked the Hartwell/Germaine factors of tenure, duration, continuing emolument, and continuous duties.
