More to the point, when the government challenged the Divisional Court’s decision in the Binyam Mohamed case to make public previously redacted paragraphs of an earlier judgment which made reference to MI6’s knowledge of the torture of Mr Mohamed by US authorities, the Court of Appeal ruled that is was for the courts to have the final word on what can and cannot be disclosed in the public interest.
