 The event which prompted this comment was the decision of Mr Justice Arnold (Chancery Division, England and Wales) in SAS Institute Inc. v World Programming Limited (noted here by the IPKat) that a series of pretty basic but crucial questions would have to be referred to the Court of Justice of the European Union for a preliminary ruling before the learned judge could get on with his day job of judging the disputes that land up before him.
