The only evidence produced at trial of documented “disability” was by applicant as stated above: Joe offers proof at trial that even though he did not file a claim until 2021 for the CT ending 2019, neither of the injuries to his head or spine should be barred since he did not have “ disability” from either injury as defined by the WCAB template until 2020.
