The Wisconsin State Bar Standing Committee on Professional Ethics (of which I am a member) recently approved Formal Opinion EF-21-01, which clarifies when you can threaten someone with criminal prosecution to gain advantage in a civil manner (and withdraws a 2001 opinion).The opinion notes that a prior rule banning the practice outright was repealed in 2007. Dentice was somehow culpable in the death of this baby - and certainly she did not meet the requirements for certification of midwives now in place in Wisconsin - the Mommy Blawger would like to point out that the acts for which she was convicted are perfectly legal and/or regulated in most of the 41 states which authorize direct-entry midwifery, including my home state of Texas.
