Those doubts are evidently within or along the lines of the French courts' concerns and a conclusion to take those into account is that:- the remedies ordered by a CTM court properly finding both infringement and validity under EU law, on the issues and evidence before it, should apply EU-wide as a default, but that the court should retain a discretion to limit its ordered remedies within the EU eg to address issues of (non-)similarity of marks between different EU member… [read post]

We would like to stress that the focus should be on the projects and that "the allocation of funds (to projects) should be driven by optimal contributions to users' priorities" as stated in the Initiation Note as well as rigorous financial controls, sound financial management and transparency".The rage is starting to abate ... but 50 million euros is a lot of money and the Kat is itching to get his paws on it.  MLex is a pretty ear-to-the-ground sort of operation, and it seems unlikely that it would have based its note on an ancient document, from which the Kat suspects the watered-down version was substituted for the original quite close to the time the MLex report was prepared -- and this would almost certainly be after the closing date of 31 January 2009 for the submission of comments.
