Article 1, paragraph 5, letter d) of the Protocol extends the same provision to fiscally transparent entities, by providing that “d) The provisions of subparagraph 1(b) of Article 4 (Resident) of the Convention shall apply to determine the residence of an entity that is treated as fiscally transparent under the laws of either Contracting State”.
