If the driver had just purchased the beer at a nearby convenience store, and exhibited clear signs of alcohol intoxication at the register, and the clerk failed in their responsibility to refuse the sale, the convenience store could be found liable for some part of the accident, but this depends heavily on the way the facts line up, and the whereabouts of the driver before the accident.
