Last week NYPD Commissioner Bratton told cops to use discretion with the elderly and handicapped and Marion Larin the Captain of the UWS 24th precinct replaced the ticket blitz by an information blitz campaign during which officers will teach jaywalkers to follow the law in order to protect themselves from dangerous traffic accidents. As a Fairfax criminal lawyer, I know that the Newport News prosecutor's office recently obtained an indictment against the mother of a mentally and physically handicapped six year old Virginia student, due to his having appeared in school earlier this years and shot his teacher (fortunately not fatally). The Bill provides:Nothing contained in the Human Rights Act shall ... burden a person's free exercise of religion by requiring the person to provide a service or to conduct business in a manner inconsistent with adherence to that person's sincerely held religious belief unless that adherence is based on race, age, religion, color, national origin, ancestry, sex, physical or mental handicap or serious medical condition. ” Such a rigid racial allotment would be a pretty clear violation of the Equal Protection Clause, I think, even given the narrow forms of race-based preferences that the Supreme Court has allowed; and I think it would violate the even more explicit provision in the Rhode Island Constitution: No otherwise qualified person shall, solely by reason of race, gender or handicap be subject to discrimination by the state, its agents or any person or entity doing business with the state.
