The majority in In re Grand Jury Matter, Gronowicz, 764 F.2d 983 (3d Cir. 1985) (en banc), held that it was indeed constitutional to prosecute an author for allegedly defrauding a publisher and a movie producer based on the author’s alleged misrepresentations about his contacts with Pope John Paul II, misrepresentations that appeared in the book itself.
