In his latest book Why the Constitution Matters, Mark Tushnet (William Nelson Cromwell Professor of Law, Harvard University) argues that the Constitution matters not because it enshrines certain “fundamental rights” enforced by the Supreme Court against majoritarian interference, but rather because the document creates political institutions that shape both the content of constitutional law (including fundamental rights) and how those rights get enforced.
