In our 11-year dataset of every published circuit-court decision that cites Chevron deference, we found that agencies prevailed under the Chevron doctrine 93.8 percent of the time when the court found the statute ambiguous and reached step two, but only 39.0 percent of the time when the court found the statute unambiguous and thus stopped at step one.
