To get qualified non-immigrant aliens to temporarily come or stay in the United States to do H-1B jobs, a U.S. employer must prove both that the offered position qualifies as a specialty occupation and that the intended holder of H-1B status meets the requirements for hire into that specialty occupation as practiced in the United States[1].
