Via Swift 1st Limited v McCourt the exercise of a like unilateral discretion in a mortgage contract such as that relied on in this case by the plaintiff must not be unreasonable (in the Wednesbury sense), dishonest, for an improper purpose, capricious or arbitrary, but the relevant discretion in the present cases is not in my opinion inherently unfair.
