I don’t think the problem is with “judicial review” as such — the Supreme Court really doesn’t invalidate many laws, and the Roberts court overturns precedents at a significantly lower rate than its predecessors — but it’s absolutely appropriate for senators (and voters) to debate the theories that potential nominees would apply.
