This decision also has an interesting passage on a point related to the res judicata doctrine.Claim 1 of the patent as granted (priority date: February 13, 1990) read:A single cell-edible oil characterized in that docosahexaenoic acid (DHA) makes up at least 15% of the oil by weight, preferably at least 20%, more preferably at least 30% and most preferably at least 35%.The patent was revoked by the Opposition Division (OD) on October 12, 2000, for lack of novelty over document D4.
