The Supreme Court considered that the applicable principles were authoritatively established in the cases of Din v Wandsworth London Borough Council and Haile v Waltham Forest London Borough Council and this was not a case where they needed to be reviewed “even though there may be errors in the reasoning in the Court of Appeal, which should not be treated as authoritative”.
