My recollection is that there was a concern at that time about the interrelationship of disciplinary claims and court proceedings arising from the same allegations of discrimination by or about lawyers, and this language was intended to make clear that discrimination claims should go to court first, and only later upon a judicial determination that unlawful discrimination had taken place, could the same allegations be made to the Disciplinary Committee.
