In a 4-3 decision written by Justice O’Donnell, for himself, Chief Justice O’Connor, and Justices Pfeifer and Kennedy, the Court held that in a prosecution for domestic violence where the state establishes the victim is a person living with the defendant as a spouse, the state does not need to prove the sharing of familial or financial responsibilities and consortium in order to prove cohabitation. In a fractured opinion written by Chief Justice O’Connor, in which Justices O’Donnell and Kennedy concurred in judgment only and Justice Pfeifer dissented, the court held that the foreseeability instruction given in this medical negligence case should not have been given, but was not prejudicial error, and reversed the court of appeals on this point.
