That interpretation might be questioned by arguing that that the reason that the Legislature left subdivision (d)(2) unchanged from prior law is because it was of the opinion that the 1992 enactment of (d)(1) containing the language "but in no event later than two years after decedent's death" reflects a clear intent that the two-year period was to act as a statute of limitations.
