No - because it has nothing to do with “copying” and everything to do with restraint of trade, monopolization and perhaps even being an "an instrument of trade control not contemplated by the Copyright Act" in the words of Justice Fish of Canada’s Supreme Court in the Kraft decision.I am not impressed by pointing to other countries such as Australia that have implemented these treaties in a manner more less dictated by the U.S.A.
