PIFSS moved to dismiss the complaint based on its alleged immunity under the Foreign Sovereign Immunity Act (FSIA). 11 Subject to exceptions, FSIA grants a foreign state (country) immunity from the jurisdiction of the courts of the US.12 The definition of a “foreign state” includes “an agency or instrumentality of a foreign state,” 13 and there was no dispute about whether PIFSS satisfied thedefinition.
