This Kat finds that several of AG:s arguments have interesting starting points: namely, (i) that pharmaceutical innovation that is to be rewarded by means of an SPC should only cover such research that concerns completely new active substances; (ii)that applying Neurim would lead to a non-transparent SPC regime; and (iii) that Neurim would also lead to an even more divergent national application of the SPC regulation. This decision is interesting to the AmeriKat in light of Henry Carr J's recent decision in Evalve & Abbott v Edwards Lifesciences [2019] EWHC 1158 in May where it was made clear that the preliminary injunction test is a series of gateways (see Kat report here). [read post]
