 In a 4-to-3 decision, the Michigan Supreme Court held that Michigan law does not recognize the doctrine because the doctrine was not a part of the common law in 1846 when the Michigan Legislature codified the common-law crimes of murder and manslaughter and their defenses; instead, the doctrine was announced well after 1846, arising for the first time in Texas in 1882 and not making an appearance in Michigan until 1971.
