  My two cents: If you're preparing a swear-behind declaration and don't have a lot of experience in this area, do yourself a favor and read Ex parte Test.com, and maybe even review the actual declaration and exhibits on PAIR. [read post]

The settlement itself has a "clear sailing" agreement (¶ 26) prohibiting the defendants from challenging the fee request, so unless there are objectors, the court will be faced with an ex parte request for this skimming of millions of dollars that should be going to the class. [read post]
