In my previous post, I noted that the judicial precedents on executive privilege were not particularly conclusive and that, with a little tweaking, they could be used to support either the President or members of Congress.But the more important point is that there are so few judicial decisions on executive privilege because Congress and the President usually work things out through negotiation.
