For the reasons set forth in this opinion, we affirm in part but remand this matter to the trial court to consider whether to conduct a Ginther hearing or to resolve the issues set forth herein by making a determination as to whether trial counsel was ineffective such that there exists a reasonable probability that, but for counsel’s unprofessional errors, the result would have been different.   The fact is, in many cases there are other options including filing a motion for a new trial, appealing a sentence that seems harsh according to sentencing guidelines, even filing a motion for a Ginther Hearing in situations where the defendant was found guilty because of inadequate counsel. You may want to consider filing a motion for a new trial, file a motion for a Ginther Hearing if you feel your conviction was a result of ineffective counsel, or introduce new evidence which may support your innocence. [read post]

 At a Ginther hearing on the issue of ineffective assistance of counsel, defendant’s trial counsel testified that he failed to subpoena the custodial of the cell phone records because of a mistaken belief that the business records exception to the hearsay rule did not require testimony from the custodian and that he thought it would be sufficient to have the complainant acknowledge her phone number on the cell phone statement.
