On appeal from: [2010] EWCA Civ 26 The Council appealed a decision that a structure built under planning permission to become a barn, but in fact built as a dwelling, was within the provisions of the Town and Country Planning Act 1990, 171B(2) in that the four year time limit for taking enforcement action had lapsed. While we wait for Bedfordshire CC v Taylor and others (former subtenants) and McGlynn v Welwyn & Hatfield DC (non secure tenancy) in the Court of Appeal, which will be a couple of months for the latter and who knows when for the former, anecdotal evidence of settling is interesting. [read post]
