   Supperstone J was “also satisfied that the Defendant was entitled on the basis of the information available to conclude that the measures ‘may’ impact on ethnic minority groups disproportionately” ([76]).This may be one not to appeal (strategically) but it will be interesting to see whether CPAG do.
