Currently, the guidance (given in Glaxo Group Ltd v Genentech Inc [2008] Bus LR 888) is that a stay should be granted, unless it appears that "the evidence is that some commercial certainty would be achieved at a considerably earlier date in the case of the UK proceedings than in the EPO".
