Attorney for Northern Alabama, and for whatever reason, did decline to prosecute, but Acker, a judge one would do well not to anger, appointed special prosecutors in Alabama who are going after Scruggs on that charge -- if you need more background, I've written a ton of posts on it, just type "Acker" in my blog's search bar to the right.
